Q&A: Notice of sheriff’s sale

Q: How many times does the public notice advertisement for a sheriff’s sale (mortgage foreclosure) have to run in a newspaper before the sale?

A: IC 32-29-7-3 requires the sheriff to have the notice published once a week for three straight weeks in a newspaper published in his county.

The sheriff covers the cost of the publication with the proceeds of the sale, so the advertisement isn’t covered by the public notice advertising law (IC 5-3-1) restriction on what the newspaper can charge.
