Q: The Monroe County Community School Corp. is in the process of hiring a new superintendent. They’ve announced the final two candidates publicly and are hosting public forums to allow people to ask the candidates questions. At the end of those forums, they’re collecting feedback from the audience on note cards. Would those feedback cards be considered public record?
A: Ask to see the cards. They definitely are public records once collected by the school board, but I don’t think school officials are required by law to disclose them.
IC 5-14-3-4(b)(8) allows a public agency to keep files on applicants for public employment confidential at the public agency’s discretion. The feedback cards easily can be argued as being part of the candidate’s application file.
