Q&A: Committees and the Open Door Law

Q: What part of IC 5-14-1.5 states that committees are subject to the Open Door Law? 

A: “Governing body” is defined in the Open Door Law at IC 5-14-1.5-2(b). The definition includes: “(3) any committee appointed directly by the governing body or its presiding officer to which authority to take official action upon public business has been delegated.”

Keep in mind with school boards that the superintendent isn’t the presiding officer, so committees appointed by the school board or school board president are subject to the Open Door Law while committees appointed by the superintendent are not.
