Q&A: Public Notice Advertising Law

Question: We have some townships that have delivered their annual report after our deadline for guaranteeing publication by the date necessary for them to meet their state-set deadline. Can the newspaper charge them a “rush charge” to cover the extra effort required by the newspaper to set the report in time for their publication deadline?

Answer: There is no provision in the Public Notice Advertising Law (I.C. 5-3-1) for a fee to expedite the preparation of a public notice to meet a statutory deadline.

In a worst-case scenario, the notice publication won’t occur by the deadline if the public official submitting it doesn’t give the newspaper adequate time to prepare the notice for publication.
