Q: A county commissioner resigned her seat when she was hired by the Washington County Economic Growth Partnership as its executive director. Later, when local officials were putting increasing pressure on the partnership to perform and be held accountable, they reduced funding. The director subsequently quit.
Now we hear she may sue the city, county and partnership. The city may have received a letter from her attorney asking questions regarding her and her position. However, a suit has not been filed.
At what point would the letter become public record?
A: Correspondence received by the city are public records subject to inspection and copying unless the city can point to a provision in the Access to Public Records Act at IC 5-14-3-4 that would say the subject matter allows the city to keep it confidential.
