Q: Do you have a book or a list of words that are not recommended or are illegal to use in a classified advertisement? Particularly, can classified housing ads say non-smoking, no drug use and no alcohol allowed?

A: HSPA has a booklet we put together with the Indiana Civil Rights Commission that’s very helpful.

Yes, the landlord can specify no smoking and no alcohol or drug use. But don’t say no smokers, no alcoholics, no drug addicts. I know that’s a fine line, but it’s what the Indiana Civil Rights Commission recommends, and the commission is the police, prosecutor, judge and jury in Fair Housing Act violation investigations.
